Gary Schnitzer received an Order of Affirmance from the Nevada Court of Appeals regarding a district court order of dismissal of a complaint in a contract and real estate action.

A district court judge entered a judgment against a client for nearly $250,000, including $100,000.00 in sanctions plus attorneys’ fees and costs resulting from alleged conduct during a foreclosure mediation. Gary Schnitzer was retained to appeal the judgment to the Nevada Supreme Court. The Nevada Supreme Court, en banc, unanimously overturned the judgment and all sanctions.

Bradley Johnson obtained a defense verdict for a hotel casino on the Las Vegas strip against a plaintiff asserting claims for false imprisonment, defamation and assault and battery. The plaintiff asked for $300,000.00 in opening statements resulting from a multiple hour detention. The hotel's position was the plaintiff was causing a disturbance on the casino floor, was asked to leave and refused. The jury found the hotel was legally justified in the detention pursuant to Nevada's citizen's arrest statute.

Bradley Johnson obtained a defense ruling for a client facing financial exposure related to a personal injury claim for permanent impairment and scaring.

Bradley Johnson successfully resolved separate litigated claims for wrongful deaths, traumatic brain injury and partial paralysis.

Tyler Watson obtained declaratory relief on behalf of a national insurance carrier that numerous claimed motor vehicle accidents were staged/fraudulent and, therefore, were not covered under the subject insurance policy.

Tyler Watson obtained summary judgment on behalf of a Las Vegas Strip hotel/casino where Plaintiff sought in excess of $10 million in damages after a guestroom dresser allegedly injured her shin, resulting in a diagnosis of complex regional pain syndrome.

Tyler Watson favorably resolved a wrongful death suit against an apartment complex stemming from a drive-by shooting that occurred on the complex’s premises resulting in a minor’s death.

Gina Mushmeche defended a hotel casino on the Las Vegas Strip in a claim for $1.7 million in lost wages by an employee who sued as a result of a battery by an off-duty co-worker. The case resolved favorably during the trial.

Gina Mushmeche obtained a $4.8 million dollar verdict for an insurance company as a result of misrepresentations made by insured on an insurance application.

Gina Mushmeche successfully defended a third party administrator in a bad faith claim where plaintiff asserted a claim for $50 million, including claims for punitive damages and intentional infliction of emotional distress, which damages were not awarded by the jury.

Bianca Gonzalez recently obtained a jury defense verdict for a hotel and casino on the Las Vegas strip against a plaintiff asserting claims for false imprisonment, defamation and assault and battery. The hotel’s position was the plaintiff had previously been trespassed from the property for unauthorized activity, continued to return to the property, and refused to leave. The jury found the hotel was legally justified in the detention pursuant to Nevada’s citizen’s arrest statute.

Bianca Gonzalez recently settled a case in favor of a commercial tenant against a property management company for misrepresentations prior to the commencement of a commercial lease and for failure to remedy certain conditions on the property which interfered with the tenant’s business enterprise.

Bianca Gonzalez successfully defended an appeal before the United States Court of Appeals for the Ninth Circuit against her client, a major insurance carrier. The lower court had granted summary judgment in a high profile case in favor of the insurance carrier finding it did not have a duty to defend or indemnify an health care professional who engaged in willful and intentional criminal misconduct. The victim of the health care professional appealed the decision as a third-party beneficiary. The Ninth Circuit Court of Appeals affirmed the lower court ruling.
